This Introductory Flight Event Participation Agreement, Assumption of Risk, Release, and Indemnity (“Agreement”) is entered into by the undersigned participant (the “Participant”) or, if the Participant is under the age of majority in the place of the event, the undersigned parent or legal guardian. This Agreement applies to the following event (the “Flight Event”):

1. DEFINITIONS; RELEASED PARTIES
(a) “Ninety-Nines” means The Ninety-Nines, Inc., an international organization of women pilots.
(b) “Released Parties” means, collectively:
(i) The Ninety-Nines;
(ii) All sections, chapters, committees, subsidiaries (including but not limited to the Friends of the Ninety-Nines), affiliated or related entities, of the Ninety-Nines, and any event-organizing groups;
(iii) The Ninety-Nines respective past, present, and future officers, directors, governors, trustees, representatives, members, employees, agents, volunteers, and insurers;
(iv) All volunteer pilots and copilots, whether or not members of The Ninety-Nines;
(v) All owners, lessors, lessees, and operators of any aircraft used for or in connection with the Flight Event;
(vi) All owners, lessors, lessees, operators, and managers of any airport, fixed-base operator (FBO), hangar, or other venue or facility used for or in connection with the Flight Event; and
(vii) All sponsors, donors, and any other individuals or entities providing services, facilities, or support for the Flight Event, together with their respective officers, directors, employees, agents, volunteers, and insurers.
(c) The terms “I,” “me,” and “my” refer to the Participant if an adult, or the parent/legal guardian when signing on behalf of a minor Participant.
2. ASSUMPTION OF RISK AND WAIVER OF LIABILITY
(a) Voluntary Participation and Understanding of Risks. I understand that participating in or being present around aircraft carries inherent and serious risks, including but not limited to aircraft incidents, pilot or ground-crew error, equipment or mechanical failure, facility conditions, collisions, weather effects, and ground hazards. These risks may result in minor, serious, or catastrophic injury, or death.

(b) Assumption of Risk. To the fullest extent permitted by applicable law, I freely and voluntarily assume all risks, known and unknown, associated with participation in or presence at the Flight Event, whether arising from inherent risks or from acts or omissions (including ordinary negligence) of any Released Party or third party.
(c) Release and Covenant Not to Sue. To the fullest extent permitted by applicable law, I release and discharge all Released Parties from all claims, demands, causes of action, damages, losses, or liabilities arising out of or related to participation in or presence at the Flight Event, and agree not to sue any Released Party for such claims. This release does not waive rights that cannot legally be waived, including claims based on gross negligence, willful misconduct, or intentional wrongdoing.
3. INDEMNIFICATION AND HOLD HARMLESS
(a) To the fullest extent permitted by applicable law, I agree to indemnify, defend, and hold harmless the Released Parties from all claims, demands, damages, liabilities, costs, and expenses, including reasonable attorney’s fees, arising out of:
(i) my (or the minor Participant’s) participation in or presence at the Flight Event;
(ii) any act or omission by me or the minor Participant; or
(iii) any breach of this Agreement.
(b) Where applicable law restricts indemnification for certain claims brought on behalf of minors, this obligation applies to the maximum extent permitted by law and remains fully enforceable as to my own claims and obligations.
4. PARTICIPANT HEALTH AND FITNESS
I represent that I (or the minor Participant) am physically and mentally able to participate and am not aware of any condition that would make participation unsafe.
I agree to disclose any specific mental or physical concerns to my pilot prior to flight.
5. MEDIA, PHOTOGRAPHY, AND PUBLICATION RELEASE
I grant the Released Parties permission to photograph, video record, or otherwise capture my image or voice (or that of minor Participant) in connection with the Flight Event and to use such media worldwide for lawful purposes encompassing and furthering the Released Parties organization.
I understand that, the Flight Event takes place in an area visible to the public and may include members of the media. As a result, my image or voice may still be captured incidentally in photographs or video taken by others who are not affiliated with the organizers. The Flight Event organizers cannot control other parties’ creation of media for this event.
6. DATA COLLECTION
I grant the Released Parties permission to contact us after the event for the limited purpose of learning whether the introductory flight influenced our interest in flight training, membership, or aviation activities.

7. PARTICIPANTS UNDER THE AGE OF MAJORITY
This section applies if the Participant is a minor in the Flight Event jurisdiction. I am the parent or legal guardian and have authority to sign this Agreement. In jurisdictions where a minor’s claims cannot legally be waived:
(a) This Agreement does not waive the minor’s non-waivable rights;
(b) I waive and release my own independent claims; and
(c) I agree to indemnify the Released Parties to the fullest extent permitted by law.

8. SEVERABILITY
If any provision of this Agreement is invalid or unenforceable, it shall be modified only as necessary, and the remainder shall remain in full force and effect.
9. GOVERNING LAW AND JURISDICTION
(a) U.S. Events.
For Flight Events in the U.S., this Agreement is governed by the laws of the State of Oklahoma without respect to its conflict of laws provisions. Any dispute shall be brought exclusively in the District Court of Oklahoma County, Oklahoma, or the U.S. District Court for the Western District of Oklahoma.
(b) Canada Events and outside the U.S.
For Flight Events outside the U.S., the laws and courts of the jurisdiction where the Flight Event takes place shall govern, to the extent enforceable.
10. ACKNOWLEDGMENT OF RIGHT TO CONSULT COUNSEL; ENTIRE AGREEMENT
I understand I may consult an attorney before signing. This Agreement is the entire agreement and may be modified only in a signed writing by The Ninety-Nines.
11. IMPORTANT NOTICE – READ CAREFULLY BEFORE SIGNING.
By signing this Agreement, you are giving up certain legal rights and assuming significant risks. Do not sign if you do not understand this Agreement.
